Statue Collection
is there a statue of limitations on when collections agencies can pursue the debt?
I made a cc payment in 8/05 and have not heard one word or received any statements since from my CC co and now all of a sudden I am getting collection notices is there a time frame on when they can come after someone?
A bit of an explanation here is in order. The SOL is the time in which you have a legal obligation to repay a debt. Once this has expired, if you are sued for the debt you have an affirmative defense AND the plantiff can usually be held liable for filing on a time barred debt.
Now just because the SOL is up does not mean they can’t try to collect, but they are basically a dog that cannot bite. If the SOL is up you can send a simple cease and desist letter and they cannot contact you again.
As for resetting the statue of limitations, that can only be done by making a payment and/or signing an agreement to pay.
